Before the Harrison County Sheriff's Office will serve any civil process, Directions to the Sheriff must be received, along with the documents you want served.
The Harrison County Sheriff's Office is mandated by the Code of Iowa to charge fees for service of civil documents. The Harrison County Sheriff's Office can refuse to serve most civil documents without the payment of advanced fees.
Persons in good standing and certain pre-approved companies may be billed for the service fees (listed below). All others may be requested to pay advanced fees.
The type of paper served and the location for service determines the amount of service fee required.
Pursuant to the Iowa Court Rules (Rules of Civil Procedure) after serving a document with a court case number, the Return of Service will be sent to the appropriate Clerk of Court unless requested differently.
If no case number is indicated, the Return of Service will be sent to the person or firm who requested the service.
Civil Paper Service Fee List
The following is a guide for the amount of Mileage fees required to serve a typical document near the community listed below:
All documents served will have the mileage added. Please be aware the mileage fee is an estimate and can be more than the amount listed.
Additional Fees
MORE THAN 1 PERSON TO SERVE AT SAME ADDRESS:
fee is indicated above, plus $20.00 for each additional person served.
MORE THAN 1 PERSON TO SERVE AT DIFFERENT ADDRESSES:
fee is indicated above for each address.
GARNISHMENTS:
The fee for serving garnishments is $90.00 plus mileage. The service and mileage fee will be added to the amount of the judgment to be garnished.
If you have the Sheriff garnish a bank, most banks require (besides the defendant's name) another identifier such as a social security number or an account number. If you do not have an additional identifier, the Sheriff will still serve the garnishment, but your chances of receiving any funds on the garnishment are reduced dramatically.
In Iowa, garnishments expire in 120 days. After expiration, any funds received
will be sent to the appropriate Clerk of Court. Federal and State laws determine the maximum amount, if any, which can be garnished from a defendant's paycheck and annually.
